Privacy Policy Statement pursuant to Legislative Deree 196/03

Pursuant to art. 13 of Legislative Decree 196/03 Privacy Code, Marchio di Qualità Giuseppe Giusti 1605 S.r.l., Data Controller, herewith informs that:

  1. the identification and fiscal data of the contracting company and of the physical person(s) acting on behalf thereof and also other information such as bank standing orders and current account details are collected, recorded, sorted and saved for purposes functional to the exercise of rights and compliance with obligations deriving from the appointment conferred and/or established by law;
  2. communication of the above data is optional; however, in the case of refusal to furnish such data, it will not be possible to stipulate the Contract, to fill orders and, more generally, to perform the contract stipulated between the parties correctly;
  3. in addition to Marchio di Qualità Giuseppe Giusti 1605 S.r.l. personnel, the aforesaid data of the contracting company and, where necessary, those of physical persons acting on behalf thereof, may also be communicated to controlling, subsidiary and affiliated companies and also to agents operating abroad on the basis of specific appointments and/or in general to third parties whose services and/or consulting is necessary to perform the contract, to IT consulting companies only within the limits necessary for functioning of the computer programs and procedures and also to the auditors of the financial statements of our Company and to the Public Authorities or Administrations for compliance with legal obligations;
  4. in accordance with art. 29 of Legislative Decree 196/03, the Data Processor is the pro-tempore head of the Administration function of our company, with service address at our registered offices in Modena, Viale Trento Trieste n. 25; the Data Controller is Mr. Enrico Ascari
  5. the data are processed also using electronic means, adopting all the necessary measures to protect the security and confidentiality thereof;
  6. the data are preserved at our company at the registered offices indicated above for the time prescribed by statutory and fiscal regulations;
  7. the data subject may exercise the rights established by art. 7 of Legislative Decree 196/03 as amended, the text of which is indicated below:

    Art. 7 Right of access to personal data and other rights

    1. The data subject has the right to obtain confirmation of the existence or not of its personal data, even if not yet recorded, and communication thereof in intelligible form.
    2. The data subject has the right to obtain indication of:
      1. the source of the personal data;
      2. the purposes and methods of processing;
      3. the logic applied in the case of processing with electronic means;
      4. the identification data of the Data Controller, Data Processors and of the designated representative pursuant to art. 5/2;
      5. the entities or categories of entities to which the personal data may be communicated or which may be informed thereof in their capacity as designated representative in the Territory of the State, Data Processor(s) or person(s) in charge of processing.
    3. The data subject has the right to obtain:
      1. update, rectification and, if interested therein, integration of the data;
      2. erasure, transformation into anonymous form or blocking of data that have been processed unlawfully, including those whose retention is not necessary for the purposes for which they have been collected or subsequently processed;
      3. certification to the effect that the operations as per letters [a-b] have been notified, also regard their contents, to the entities to whom or which the data have been communicated or disseminated except where the provision of such information is impossible or involves a manifestly disproportionate effort compared with the right to be protected.
    4. The data subject has the right to oppose, entirely or in part:
      1. for legitimate reasons, processing of its personal data even if pertinent to the purposes for which they have been collected;
      2. -processing of its personal data for the purpose of sending advertising or direct mailing material or for market surveys or commercial communication.
